Liability Waiver, Release and Assumption of Risk

The Sweat Lab NC, LLC, doing business as The Sweat Lab MMA & Fitness
106 E Railroad Avenue, Unit H, Gibsonville, NC 27249 · 336-221-4257 · mike@sweatlabnc.com

PLEASE READ THIS ENTIRE DOCUMENT CAREFULLY BEFORE SIGNING. IT INCLUDES A RELEASE OF LIABILITY AND A PROMISE NOT TO SUE, INCLUDING FOR INJURIES CAUSED BY THE ORDINARY NEGLIGENCE OF THE SWEAT LAB. IT AFFECTS YOUR LEGAL RIGHTS.

The participant is the person named in the sign-up, booking or profile this document is signed with. Their emergency contact is the one they give us.

In this document, "I", "me" and "my" mean the participant. If the participant is under 18, "I" also means the parent or legal guardian who signs, signing for the minor and for themselves (see Section 9). "The Sweat Lab" means The Sweat Lab NC, LLC.

1. Activities covered

This document covers everything I do at or with The Sweat Lab, now and in the future, until I revoke it in writing: free trial classes, group classes, personal training, open mat and open roll, sparring, drills, conditioning, strength training, use of the facility and equipment (including the cage, ring, bags and weights), events, and any related travel or off-site activity organized by The Sweat Lab (the "Activities"). Activities include boxing, kickboxing, Muay Thai, mixed martial arts (MMA), jiu-jitsu, grappling, wrestling, and fitness training.

2. Assumption of risk

I understand that martial arts, combat sports and strength and conditioning are physically demanding contact activities with inherent risks that cannot be eliminated, even when coaching is careful and equipment is in good condition. These risks include, among others:

  • being punched, kicked, kneed, elbowed, thrown, taken down, choked, joint-locked, or landed on by another person;
  • bruises, cuts, sprains, strains, dislocations, broken bones, and torn ligaments, tendons or cartilage;
  • injuries to the eyes, ears, nose, teeth and face;
  • concussion and other brain injury, including injury that is not noticed right away and effects that may be long-term or permanent;
  • neck and spinal injury, including paralysis;
  • loss of consciousness from chokes or strikes;
  • heat illness, dehydration, heart attack, stroke and other medical events brought on by exertion;
  • skin infections and other communicable diseases spread by contact or shared mats and equipment (such as ringworm, staph/MRSA, herpes gladiatorum, and respiratory illness);
  • injury caused by equipment, mats, flooring, the cage or ring, or facility conditions; and
  • injury caused by the actions or carelessness of other participants, or by my own actions;
  • in rare cases, permanent disability or death.

I understand these risks, I choose to participate anyway, and I voluntarily assume all of them, known and unknown, including risks caused by the ordinary negligence of the Released Parties.

Initials:

3. Health and safety promises

I promise that:

  1. I am physically able to take part in the Activities, or I have asked a doctor about the Activities and I am participating with that advice. The Sweat Lab recommends that everyone, and especially anyone with a heart, blood pressure, breathing, bone, joint, seizure, pregnancy-related or other medical condition, get a doctor's approval before training.
  2. I will tell my coach, before class, about any injury, medical condition, recent concussion or medication that could affect my safety, and I will tell staff right away if I feel pain, dizziness, chest discomfort, shortness of breath or any other warning sign.
  3. I will not train or spar if I have had a concussion or head injury until a medical provider clears me.
  4. I will not train if I have a skin infection, open wound that cannot be covered, or contagious illness. I will train in clean gear and keep fingernails and toenails trimmed.
  5. I will not train under the influence of alcohol, cannabis, illegal drugs, or any medication that affects my judgment or coordination.
  6. I will follow coaches' instructions and posted gym rules, train at a level within my ability, wear required protective gear, and stop immediately when a coach or training partner says to stop. I will only spar when a coach has approved it.

The Sweat Lab's coaches are not medical providers. Nothing they say is medical advice.

4. Release of liability and promise not to sue

In exchange for being allowed to take part in the Activities, I, for myself and for my heirs, family, estate, personal representatives and assigns, RELEASE, WAIVE AND DISCHARGE the Released Parties from, and PROMISE NOT TO SUE them for, any and all claims, demands, losses and liability for injury, illness, death, or damage to property that arise out of or relate to the Activities or my presence at The Sweat Lab, INCLUDING CLAIMS CAUSED BY THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY.

"Released Parties" means The Sweat Lab NC, LLC and its owners, members, managers, employees, coaches, instructors, independent contractors, volunteers and agents, and the landlord and owner of the premises.

This release does not apply to injury caused by gross negligence, or by willful, wanton or intentional misconduct, or to any right that North Carolina law does not allow to be waived.

Initials:

5. Responsibility for my own conduct

I agree to pay for, and to defend and hold the Released Parties harmless from, any claim, loss or expense caused by my own intentional or careless conduct toward another person or property at The Sweat Lab, or by my breaking this agreement.

6. Medical emergencies

If I am hurt or become ill, I authorize The Sweat Lab's staff to give first aid and to call emergency medical services and have me taken to a hospital if they think it is needed. I understand The Sweat Lab does not provide health or accident insurance coverage for me, and I am responsible for the cost of any medical care, including ambulance transport.

7. Personal property

The Sweat Lab is not responsible for lost, stolen or damaged personal property, unless caused by its gross negligence or willful misconduct.

8. Photos and video

The Sweat Lab takes photos and video during classes and events and uses them on its website, social media and advertising. Unless I opt out below, I give The Sweat Lab permission to use photos, video and audio of me taken at The Sweat Lab for these purposes, without payment. For participants under 18, The Sweat Lab will not post a child's full name with their image without a parent's separate permission.

Check this box to OPT OUT of photos and video. Leave it unchecked to give permission. Opting out does not affect my membership. The Sweat Lab will make reasonable efforts to keep me out of posted content, but cannot fully control wide shots of group classes or events, or what other people record. I can change this choice at any time by emailing mike@sweatlabnc.com.

9. Participants under 18

If the participant is under 18, the parent or legal guardian signing below:

  1. confirms they are the participant's parent or legal guardian with authority to sign, and gives permission for the minor to take part in the Activities;
  2. has read this document, explained it to the minor, and agrees to all of it on the minor's behalf and on their own behalf;
  3. releases the Released Parties from the parent's or guardian's own claims (including claims for the child's medical expenses and loss of services), as set out in Section 4;
  4. to the fullest extent North Carolina law allows, releases on the minor's behalf the minor's claims as set out in Section 4; and
  5. to the fullest extent the law allows, agrees to indemnify and hold harmless the Released Parties from any claim brought by or on behalf of the minor that this document releases.

Parents and guardians are responsible for their child before and after class. Children must be dropped off and picked up on time, and a parent or guardian must stay or arrange supervision for children who are not in class.

10. General terms

Entire scope. This document is meant to be as broad and inclusive as North Carolina law allows. If any part is found unenforceable, that part will be limited only as much as needed and the rest stays in effect.

Governing law. North Carolina law governs this document. Any lawsuit about it must be brought in the state or federal courts for Guilford County, North Carolina, except that either side may use small claims court where it applies.

Electronic signature. I agree that my electronic signature, initials and check marks on this document are as binding as a handwritten signature. I can download a copy at any time from my member account at www.sweatlabnc.com (Login, top right) or ask for one at the front desk.

Duration. This document applies to all of my future participation until I revoke it in writing. Revoking it does not affect anything that happened before.

I HAVE READ THIS ENTIRE DOCUMENT. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR INJURIES CAUSED BY ORDINARY NEGLIGENCE. I AM SIGNING IT FREELY AND VOLUNTARILY, AND I AM AT LEAST 18 YEARS OLD (OR I AM THE PARENT OR LEGAL GUARDIAN SIGNING FOR A MINOR).
